Please read these Terms of Service carefully before using the Paysio platform. Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. By accessing or using the Service you agree to be bound by these Terms.
1. Description of Service
Our Service provides a platform for businesses and individuals ("Users") to collect payment form information and securely transmit it to various third-party payment processors and providers ("Payment Processors"). We act as a technology conduit and are not a party to any payment transaction.
2. User Accounts
To use our Service, you must create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding your password and for any activities or actions under your password. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
3. Use of the Service
You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to use the Service in any way that violates any applicable law or regulation, for the purpose of exploiting or harming minors, to transmit unsolicited advertising or spam, to impersonate the Company or any other person, or to engage in any conduct that restricts or inhibits anyone's use of the Service.
4. Payment Information and Third-Party Processors
Our Service facilitates the collection and transmission of payment information to Payment Processors. We do not store your full credit card or bank account information on our servers. Your use of a third-party Payment Processor is subject to their terms of service and privacy policies. We are not responsible for the actions or inactions of any third-party Payment Processor. You are solely responsible for all transactions processed through your account.
5. Fees
We may charge fees for the use of our Service. Any applicable fees will be disclosed to you prior to you incurring them. We reserve the right to change our fees at any time, and we will provide you with advance notice of any fee changes. All fees are exclusive of all taxes, levies, or duties imposed by taxing authorities.
6. Intellectual Property
The Service and its original content, features, and functionality are and will remain the exclusive property of Paysio and its licensors. The Service is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Paysio. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service as authorized in these Terms.
7. Termination
We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms. All provisions of the Terms which by their nature should survive termination shall survive termination.
8. Indemnification
You agree to defend, indemnify, and hold harmless Paysio and its licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses resulting from or arising out of your use and access of the Service, a breach of these Terms, or content posted on the Service.
9. Limitation of Liability
In no event shall Paysio, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.
10. Disclaimer
Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
11. Governing Law
These Terms shall be governed and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
12. Changes
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will provide at least 30 days' notice prior to any new terms taking effect. By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms.
